TERMS & CONDITIONS 
“You” and “your” refers to the Hirer, “We” or ‘Us” refers to the Macquarie Mediation Centre (MMC)
  1. Booking Confirmation a. Room bookings must be confirmed with full payment of the applicable room hire fee. b. The party booking the room is responsible for the room hire fees and any applicable costs incurred in full. c. An additional fee of $99 may apply to some bookings to cover the cost of cleaning and room preparation. These include bookings that are, or extend into, after-hours; span multiple days; and/or cover the whole floor, or more than three Mediation Rooms.
  1. Cancellation 
    a. No cancellation fees apply for bookings cancelled more than 7 days prior to the booking time.
    b. Cancellations made between 0 and 24 hours of the booking time will incur a fee of 100% of the hiring fee.
    c. Cancellations made between 24 hours and 7 days of the booking time will incur a fee of 50% of the hiring fee.
    d. Bookings that are terminated before the duration of time booked for are not refundable. This accounts for the possible bookings forfeited once a room(s) is reserved.
  1. Venue Hire and Usage
    a. The Hirer will have exclusive use of the rooms which have been hired and non-exclusive access to common areas, including the kitchenette, bathroom, and foyer.
    b. The Hirer will have complementary use of the Internet service throughout the duration of the booking.
    c. Smoking is not permitted within the premises.
    d. Drugs and alcohol are not permitted within the premises.
  1. Hiring Conditions
    a. Reasonable care of the facilities should be taken during your usage of the facilities. If MMC are required, at their discretion, to clean or otherwise repair or remediate the facilities as a result of anything arising from your use, then this will be charged to you, together with any administration charges.
    b. If you would like to leave your belongings in the room for collection the next day, please arrange this with Reception by 4.30pm on the final day of the booking. If these arrangements are not made in advance, an additional fee of $50 (incl GST) will be payable to MMC prior to the articles being released.
    c. 24 hours’ notice MUST be given if you require the room to be reconfigured.
    d. MMC reserves the right to accept new bookings for rooms that have been formally booked but confirmed by the Hirer to be no longer required, without refunding any portion to the Hirer.
  1. Standard Hours
    1. Standard room hire hours are from: 9:00am – 5:00pm weekdays.
    2. Half-day hire is available from: 9:00am – 1:00pm or 1:00pm – 5:00pm.
  1. After-hours Access
    1. Rooms can be booked outside of Standard Hours either before the booking or during the booking. Refer to the applicable rates and/or discuss these with our receptionist.
    2. Should clients request to extend the duration of their booking, rooms will be invoiced at an hourly rate.
  1. Secure Access
    1. If you require secure access to any or all of your rooms for the duration of your hire period, or for long term hire, this can be facilitated as a complementary service during your hire period. Please provide our receptionist with at least 24 hours’ notice so that access controls can be programmed on time. Failure to return access controls to reception will result in a charge for their replacement including an administration fee.
    2. MMC accepts no responsibility for any lost, stolen or damaged property stored within its premises and rooms hired.
  1. Catering
    1. All catering is outsourced and can be arranged on request. Please refer to the catering options available on our website or at reception. Please note, food and beverages from outside of the venue are prohibited as the venue is fully catered.
  1. Skype for Business
    1. MMC uses Skype for Business as its Teleconferencing software. We cannot accept any responsibility for incompatibility of other software with Skype for Business.
  1. Decoration
    1. No items are to be nailed, screwed, stapled or adhered to walls, doors or other surfaces in the premises. Any temporary signage in common areas must be provided to reception for approval.
  1. Compliance
    1. The Hirer is responsible for compliance with all applicable laws and regulations in relation to bookings and the orderly behaviour of its employees, agents, contractors and guests.
    2. We reserve the right to intervene as we consider necessary including, without limitation, adjusting any set up to ensure compliance with fire, health and safety codes.
  1. Indemnity and Insurance
    1. The Hirer is liable for and indemnifies Macquarie Mediation Centre from and against all actions, claims, demands and damages for which Macquarie Mediation Centre may become liable or suffer in respect of;
      • Damage to equipment and property arising out of the actions of the Hirer and/or its party
      • Injury or death arising out of the actions of the Hirer and/or its party
      • Any breach of these Terms and Conditions
    2. MMC accepts no responsibility for any loss, damage or theft of the property of the Hirer or of any third party. Any items that have not been collected within 7 days of the use of the facilities may be disposed of by MMC.
  1. Privacy
    1. We respect your privacy and the confidentiality and security of personal information provided by you to us. How we handle your personal information is explained in our Privacy Policy linked at the foot of our website.
  1. Terms of Payment
    1. The Hirer who makes a booking accepts that they are entering into a contractual agreement with MMC, in which they are fully liable for payment and responsible for ensuring that all invoices are paid by their due date.
    2. All prices exclude tax.
    3. This is the case:
      • irrespective of whether, or when, the Hirer’s own client(s) pays the Hirer’s own fees to them.
      • if the Hirer has requested that we address their invoice to their client, or another third party, who refuses to make payment.
      • if the Hirer has booked on behalf of another party, or parties, who refuse to make payment.
    4. MMC will endeavour to accommodate each booking request as per the Hirer’s wishes. However, in the absence of repeated attempts to obtain payment from additional relevant parties, the original Hirer will be responsible for all outstanding costs associated with the booking they have placed.
